Terms
These terms cover using Chromary and claiming an official color. Chromary is run by RIOT LLC, a Nevada company (“we”). Questions: hello@chromary.app.
01Using Chromary
Chromary is free to use: the dictionary, the drops, Build, Explore and every color page. You may use the colors, names, numbers and kits you find here in your own work, including work for clients.
Please do not scrape the site at a rate that slows it for others, try to break it, or use it to mislead people about who made something.
02Colors, names and numbers
Nobody owns a color, and neither do we. The dictionary's names, its CH numbers, its writing and its design are ours. CH numbers are given by us and never change.
03Names, trademarks and copyright
We have done our best to name every color in plain words that belong to no one, and not to use anyone's trademark or copyrighted work. Official colors carry a brand's name only because that brand claimed them.
If you believe one of our names uses your trademark or copyright, write to hello@chromary.app with the name, the color and the rights you hold. We will look at it promptly and, if it does, rename the color. Its CH number stays the same, and its old address forwards to the new name.
04Official colors
Claiming a color buys an entry on Chromary, not the color itself and not any trademark. An official color's entry carries the brand's name, a link to its site and, once confirmed, the verified mark. One brand holds each entry at a time.
Plans are monthly, yearly or Forever. Payment is taken by Stripe at checkout, and the color goes live when the payment goes through. Monthly and yearly plans renew until cancelled. Cancel any time by writing to hello@chromary.app; the entry stays yours to the end of the period you paid for, and is then free to claim again. We do not refund part periods, except as these terms say.
05Forever
Forever is paid once. The entry is held for as long as Chromary runs, with an address of its own on chromary.app. Forever is for the brand itself: the email used at checkout must be at the domain the entry links to.
If we ever stop running Chromary, we will tell Forever holders by email at least 90 days before.
06The verified mark
The verified mark comes on when someone at the brand opens a link we send to an address at the domain the entry links to. It says that domain's email confirmed the claim, and nothing more.
07What names and links may not do
An entry's name and link may not be hateful, sexual, or violent; pretend to be another person or brand; infringe someone else's rights; or lead to scams, malware or anything unlawful. We take down entries that do. When we take one down, we refund what is left of the plan: the unused part of a month or year, or for Forever the price less one fifth for each full year it was held. An entry taken down for fraud gets no refund.
08Offers and transfers
Anyone may make an offer on an official color. Offers come to us, and we pass them to the holder. Forever entries can change hands, only through Chromary; monthly and yearly entries cannot. When a sale goes through, we take 15 percent of the price from the seller, and the buyer's name and link replace the seller's. The CH number stays the same.
09Brand disputes
A brand that owns a registered trademark in a color can ask for that color's entry back from a holder who took it in bad faith. Send the registration to hello@chromary.app. If we agree, the entry passes to the brand and the holder is refunded what they paid.
10Photos and fonts
Photos on Chromary come from Unsplash under the Unsplash License, each credited to its photographer. Fonts come from Google Fonts under their own open licenses, which come with every font download.
11No promises beyond these
Chromary is offered as it is. We work to keep it accurate and running, but we do not promise it will be free of mistakes or always available, and colors look different on different screens and in print. To the extent the law allows, our total liability to you is limited to what you paid us in the twelve months before the claim, and we are not liable for indirect or lost profits.
12Changes, and the law
We may change these terms; when a change matters to a paying holder, we will email them before it takes effect. These terms are governed by the laws of Nevada, and disputes go to the courts there.
